Your initial consultation is crucial in understanding your case. During this time we figure out the best way forward and decide what steps to take—or avoid—based on your specific and unique circumstances.

Cost

If we find that we are able to work with your case you will need to make a payment of $150 for a Zoom/Phone appointment, or $200 for an in-person meeting. All consultations are 30 minutes and in-person consultations are held at the Law Office of Abhisha Parikh in Edison, New Jersey. 

Please have any required documentation that pertains to your case ready upon request.

During Your Consultation

We Will: 

  • Assess the Potential Relief: Our experienced attorney will thoroughly evaluate your case to determine if there is any available relief. Whether you are seeking family-based immigration, employment-based visas, asylum, or other forms of relief, we will analyze your situation to provide you with clear guidance.
  • Explain Available Options and Procedures: We will explain the various options available to you and outline the general procedures associated with each option. Whether you’re considering adjustment of status, consular processing, or other immigration processes, we will break down the steps involved and answer any questions you may have.
  • Provide Recommendations: Based on our assessment of your case, we will offer personalized recommendations. We will advise you on the best course of action, considering your specific circumstances and immigration goals.
  • Confirm Representation: If we determine that your case is within our scope and that we can assist you effectively, we will confirm whether we are willing to take on your case. Our attorney will explain the next steps in retaining our services.
  • Legal Fee Quote: Following our assessment and recommendations, we will provide you with a transparent legal fee quote. Our fee structure is based on the complexity of your case and the services required.

We Will NOT:

  • Offer Explanations: Our consultation is aimed at providing professional legal advice, and as such, we do not provide explanations on how to handle your case on your own. We strongly advise against attempting to navigate complex immigration laws without proper legal representation.
  • Review Non-Professional Documentation: While we welcome any documentation you provide, we will not review or comment on materials prepared by non-lawyers to improve your case. It’s crucial to have legal professionals ensure the accuracy and effectiveness of your documentation.
  • Provide Legal Strategy Guidance: We do not offer advice on specific arguments to make or which documents to obtain. However, we will guide you on the general procedures and options available based on our assessment of your case.
  • Guarantee Refunds: Unfortunately, we cannot refund the consultation fee if you are dissatisfied with the recommendations or legal fee quote for your case. The consultation fee covers the time and expertise of our attorneys in evaluating your case, providing recommendations, and offering a fee quote based on the information provided during the consultation.

Ensuring accuracy in your responses is crucial as we base our case evaluation on the information provided in your intake form. Throughout the entire case, we refer to and rely on the facts regarding entries/exits, marital history, and arrest history from your intake form. Your consultation also relies on this information. Any incorrect information on your intake form, if not corrected during the consultation, could significantly impact the case outcome and potentially lead to unintended negative consequences.

Who Is Allowed At Your Consultation?

The foreign national must participate in the consultation, whether it’s conducted in person or over the phone/zoom. Ideally, we encourage the Petitioner’s presence as well. If the foreign national is physically with the Petitioner during the consultation, they don’t need to be on a three-way call, as long as they are available for questions. 

Interpreters or other necessary individuals may join telephone consultations. However, only the petitioner and foreign national are allowed at in-person consultations; no other individuals will be permitted. If you require another person, like an interpreter, the consultation must be conducted via phone. For scheduling a three-way call, please request assistance at least 24 hours before the consultation. Otherwise, we assume you have arranged for all parties to be on the line at the scheduled appointment time.

Time Zones

Consultation times are scheduled based on Eastern Standard Time (EST) in New Jersey, United States. It’s essential to accurately determine the time difference between your location and EST to ensure you don’t miss your consultation. We recommend researching the internet to find out this time difference.

Tardiness/No-Show

All consultations – whether conducted by zoom/phone or in person – are meant to start on time. Joining a meeting or arriving more than 15 minutes late will be acted on as a missed consultation. In-person appointments will still end at its designated time, despite a late arrival.

Key Information to Provide

While we strive to cover all pertinent inquiries, it’s crucial to provide comprehensive and accurate details, even if we overlook specific questions.

  1. Entry and Exit Details: The initial step in our consultation is to create a timeline of entries/exits, immigration benefit applications, arrests, marriages, children, and other relevant details. It’s essential for you to gather as much information as you can beforehand to facilitate this process. It’s crucial to accurately detail all entries and exits from the United States, including the month/year and manner of entry for each instance. This information helps us assess your immigration history comprehensively.
  2. Arrest History: Disclose any arrests, whether or not there was a conviction, anywhere in the world. This includes incidents involving both the foreign national and, if applicable, the petitioner for fiancé(e) visas. Providing this information upfront enables us to address any potential legal implications effectively.
  3. Marital History: Document all current and prior marriages for both the petitioner and beneficiary (foreign national), regardless of their legality or outcome. This encompasses marriages, common law unions, tribal marriages, and those terminated by divorce, annulment, or the death of a spouse. Understanding your marital history is crucial for determining eligibility for certain immigration benefits.
  4. Prior Immigration History: Inform us of any previous immigration-related matters, such as prior asylum claims or attempts to adjust status. This includes any interactions with immigration authorities, visa denials, or petitions filed on your behalf. Clear communication about your immigration history enables us to address potential challenges proactively.

When Legal Issues Arise That We Cannot Immediately Answer

During your consultation, we aim to provide a legal opinion without needing to conduct research. However, if necessary, we’ll deliver a legal opinion within one week after your consultation.

Refund Policy

Once booked, fees are non-refundable. You can reschedule your appointment up to 24 hours beforehand, but no-shows will forfeit their fee. Consultations are non-transferable. Exceptions due to extenuating circumstances may be considered on a case-by-case basis. Please contact us to reschedule or discuss any concerns.
